Judge denies stakeholders request for representation in Celsius bankruptcy case

The judge also declined to declare CEL token “not a security,” despite related rulings in the SEC vs Ripple case. Judge Martin Glenn shot down efforts to have a special shareholders class declared in the Celsius Network bankruptcy case in a court document filed on Aug. 25. The judge also declined to settle whether or not the CEL token was a security.  In a motion filed on July 25 and heard before the United States Bankruptcy Court Southern District New York on Aug. 14, investor Otis Davis asked the court to create a legal class for investors to be considered separate from Celsius Network employees and customers. Davis also requested that the court sanction the legal team representing the Unsecured Creditors Committee (UCC) over alleged failure to disclose required information. Over 1 million ETH has been withdrawn since the Shapella hard fork on April 12. However, a significant chunk of addresses has gone back to re-staking their ETH. Ethereum blockchain underwent a successful Shapella upgrade on April 12, making way for validators to withdraw their staked Ether (ETH) from the Beacon chain after three years. After seeing over a million ETH in withdrawals in the first week, the amount of staked ETH has now surpassed the number of ETH being withdrawn for the first time after the Shapella upgrade. Data from the on-chain analytic firm Nansen suggests that there are more ETH being staked at present than withdrawal requests. As of April 17, the ETH staking volume ETH staked 124,000 ETH exceeded the withdrawal volume of 64,800 ETH for the first time. After being robbed of $196 million in a flash loan attack, Euler Finance has convinced its hacker to return most of the funds.
